A solution for foreigners from outside the Schengen area who crossed the Polish-Ukrainian border fleeing the war and do not have a Polish or Schengen visa.
Countries such as India, Nepal or African countries do not have Schengen visa-free travel and citizens of these countries cannot normally enter Poland or travel to other Schengen countries without a visa. However, they can return to their countries without any problem.
Foreigners without a visa are admitted to the Republic of Poland on the basis of art. 32 sec. 1 of theAct on Foreigners in a special mode: the commanding officerof the Border Guard post may allow a foreigner to enter the territory of Poland for a stay of no more than 15 days. However, if they would like to stay in Poland, they must return to their country of origin and apply for a visa to Poland there.
Similar actions must be taken bystudents leaving Ukraine or students of other countries escaping to Poland before the war,if they would like to stay in Poland and continue their education here. And then properly prepare the documents and go with them to their country of origin, where they will quickly obtain a visa to Poland,thus legalizing their stay in the territory of the Republic of Poland.
