Legal Facilities for foreigners staying in Poland, introduced due to state of epidemic threat of virus SARS-Cov-2.
Current legislation allow foreigners to stay legally in Poland if they want to continue with the aim of their visit or if they cannot leave the country due to the spreading of the virus. These regulations apply also to Ukraine refugees.
There are the following facilities:
prolongation of the validity of Temporary Residence Permits and Residence Cards expiring after March 14, 2020 for the duration of 30 days, counting from the day after the state of epidemic threat has been called off. This takes places by virtue of law.
prolongation of stay periods and validity of visas in cases when the last day of stay falls after March 14, 2020, for the duration of 30 days, counting from the day after the state of epidemic threat has been called off. This takes place by virtue of law.
stay in Poland is considered legal by virtue of law, this applies to foreigners, who were staying in Poland on March 14, 2020 , on the basis of short- term residence titles, that is:
Prolongation – by virtue of law – of deadlines for applying for Stay Permits, prolongation of visas or prolongation of stay on basis of visa-free traffic, that is: applications for Permanent Stay, for long-term EU Resident Stay, for prolongation of visa, prolongation of stay on basis of visa-free travel – till the 30th day counting from the day after the state of epidemic threat has been called off.
This applies to you even if you entered Poland after March 14, 2020, on the basis of short-term resident title ( ex. on the basis of a Schengen visa or visa-free traffic).
However this will not apply to you if you didn’t have a resident title giving you the right to enter Poland , and entered Poland only on basis of an ID or decision of Border Guards.
